I uploaded this file mostly to ensure it wasn't entirely lost, as NASA has deleted all other First Woman content from the internet due to Trump's DEI purges. I'm not entirely sure, however, if the file is actually public domain, and I'd like a second opinion. The source page says "First Woman Issue No. 1: Dream to Reality By NASA is licensed under a Creative Commons License." The Creative Commons license link, however, links to a CC-BY-NC license. And although the file was produced by NASA, one of the executive producers was Harla Sherwood of the National Institute of Aerospace, which is a non-profit organization sponsored by NASA (rather than being part of NASA directly). If the nonprofit was doing work-for-hire on a federal contract, the product would still be PD. One way to be sure would be to contact the National Institute of Aerospace and ask if they intend to assert a copyright, which is a different question from standing but still relevant. Although the original content in the insignia is public domain due to the defective notice (and probably it being a work of the U.S. government), it prominently includes copyrighted content. The defective notice doesn't invalidate Disney's underlying character copyright. Unless we erased Dumbo from the image, it cannot be freely reused. The American legal concept of character copyrights is very unintuitive and often surprising to folks (as most countries only protect characters as explicit parts of works, not as entities in their own right). I am quite aware of COM:CHAR. A couple of things: A character copyright represents a more nuanced web of traits (a character) and not just a simple visual depiction. The character of Dumbo may be copyrighted (though see below), but this simple visual illustration is not. The concept of a flying elephant is not copyrightable and this illustration notably has several visual traits which differ from any Disney-published iteration of Dumbo, including ears which are a single tone (and not two-tone), a forked tail like that of an airplane stabilizer, and wearing an aviator helmet. Also, the original character copyright of Dumbo (drawing from the storyline) is likely expired. Helen Aberson-Mayer and Harold Pearl wrote the story of Dumbo and it was published by Roll-a-Book in 1939. The story was later sold to Disney, but importantly the Roll-a-Book story was not renewed in 1967, which likely caused the storyline character to lapse into the public domain. @Adamant1: One of us is confused, though I don't know which. Here's how I see it.

• An Italian-language ad would have been shown in Italy, not the U.S. Given the URAA restoration, the lack of a copyright notice in that Italian-language ad is completely irrelevant.
• If the U.S. is the first country of publication for the image, including possibly allowing for simultaneous publication elsewhere:
  • If we can show that image was published without notice in the U.S. in the relevant period ), then it lost U.S. copyright (PD-US-no notice) and the Italian aspect is only relevant to text.
  • If it was published in the U.S. with notice then it will still be copyrighted in the U.S. until 2069-01-01.
• If the U.S. was not the first country of publication for the image:
  • Whether that first publication was in Italy or elsewhere, and if there isn't a reason for it to have been uncopyrighted at time of first publication (unlikely to have such a reason, certainly wouldn't in Italy), then to have any chance of it not now being copyrighted in the U.S. it would have to have fallen out of copyright in that country before 1996-01-01. That seems really unlikely, though I realize that there are certain circumstances where Italy in particular has unusually short copyright terms.

I doubt any text here rises to the level of copyrightability, but the JCS logo at the top could have a copyright of its own independent of the main visual, and it was almost certainly first published either in the UK or U.S.

UK would be exactly the same U.S. issue as Italy, plus there is no way the term there was less than 70 years, so certainly still in copyright in the UK. If first publication (sometimes a tricky issue because of legally "simultaneous" publication) was in a country that was a member of the Berne Convention in 1996 (trickier for countries that joined later, but not relevant here), and if it was still in copyright in that country in 1996, then it gets exactly the same U.S. protection as if it had been published in the U.S. with notice and correctly handling all of its renewals. No need ever actually to have given notice. CC BY isn't public domain. If the copyright owner released the video under a license, yes any artwork owned by them in the video is under the license. I don't want the files to be deleted either, but I think the CC license on the Xbox Mexico channel was not intentional. Also, I did say Mojang is owned by Xbox Game Studios, but I think I spoke wrong, it's not "owned" just "under" another division of Microsoft.  Keep The file description states: "This file comes from the Xbox México YouTube channel, an official subsidiary of Xbox, which has released the source video under the CC BY licence. Even if the file contains copyrighted content, the owner of the rights released it under a Creative Commons license." Xbox is owned by Microsoft. Minecraft is owned by Mojang, Mojang is owned by Microsoft. This type of uploads is fair game for Commons. Hell, there's a whole category for free depictions of non-free works. Furthermore, if the licensing was accidental, then they would've probably changed the license back. Plus, CC-BY is turned off by default and tucked away in the video settings on YouTube, so Xbox México went out of their way to turn it on, knowing its effects. (it's a company, they know what a license is) I already had a conversation with another guy about a similarly licensed Minecraft image, where we came to the same conclusion. These files are dated 1953 and tagged with CC licenses, CC licenses would not have existed at that time. The source https://www.scielo.br/j/bioce/a/LF5wfPYxqgJ6WHMWHHHSFYf/ states "This work is licensed under a Creative Commons Attribution-NonCommercial 4.0 International License" which is not acceptable on Commons as it is non-commercial (COM:L).
The content was published in 1953 and the author seems to be en:Marta Vannucci who died in 2021. I'm not super familiar with COM:BRAZIL, is it PD as it was published more than 70 years ago, or not yet PD since not yet 70 years pma?
