Lubbock Tornado Memorial photos
There's no freedom of panorama for 3D works of art, even ones installed in public spaces, installed on or after January 1, 1978, under US copyright law per COM:FOP United States, and photos of such artwork are considered derivative works for which there are two copyrights to consider: one for the artwork itself and one for the photo. Even though the en:Lubbock Tornado happened in 1970, this particular memorial was installed in 2020, which also means that a copyright notice or copyright registration isn't required for the memorial to eligible for copyright protection under US copyright law. So, unless the COM:CONSENT of the person who created/designed the memorial (i.e., its copyright holder), who appears to be an architect named Stephen Fauk per this, can be obtained, I don't think these can't really be kept by Commons. --Marchjuly (talk) 08:37, 23 May 2025 (UTC)

The protesters wanted the banner to be seen by as many people as possible. Therefore, the argument that this photo violates copyrights doesn't seem to be reasonable. Source however is own work, and this parcel automat is placed outside the supermarket (noticing the little 'no-entrance' flaps in the lower right). These kinds of vending machines are even placed in public space to be accessible outside office hours. Imho FOP applies here, no additional persmission is needed. - France's law change to 70pma did not take effect until April 1, 1997. For the URAA, it mattered what the law actually was in the source country on Jan 1, 1996. Subsequent law changes (retroactive or not) do not matter. The transitional rules in that law make clear that owners of revived rights (for works in the public domain as of July 1, 1995) did not apply to any exploitations before April 1, 1997, so the works were still considered public domain on Jan 1, 1996. There is some gray area for works which expired on January 1, 1996 itself, as the EU directive came into force six months earlier, and it was clear such works would become re-copyrighted (and this later 1997 French law would allow copyright infringement charges for someone who exploited such works between Jan 1 1996 and April 1 1997). However, the law still actually in place on January 1, 1996 was still the 50pma law with wartime extensions, which may have been enough to satisfy the URAA clause of public domain in its source country through expiration of term of protection.
