بەڕێوەبەردنیی یاساکان

لە ساڵی ٢٠١٨ەوە ڕێکخراوەی جیھانی خاوەندارێتی ھزری (WIPO) کە دەزگایەکی نەتەوە یەکگرتووەکانە، یاسای پاراستنی نووسەران، ئاوازدانەران و مافی ھونەرمەندان (یاسای مافی چاپکردن)ی ساڵی ١٩٧٠ی خستووەتە پێڕستی یاساییەوە. وەک یاسای سەرەکی IP کە لەلایەن دەسەڵاتی یاسادانانی ئێرانەوە دەرچووە.[1] سەنتەری توێژینەوەی پەرلەمانی ئیسلامی کۆماری ئیسلامی ئێران دەقی فارسی ئەم یاسایەیە.[2] WIPO دەقی وەرگێڕدراوەی ئینگلیزیی یاسای بنکەدراوەی WIPO Lexە.[3]

یاسا گشتییەکان

بەپێی یاسای پاراستنی نووسەران، ئاوازدانەران و مافی ھونەرمەندانی ساڵی ١٩٧٠،

  • بەرھەمەکانی مافی چاپکردن، وەک بەرھەمی ئەدەبی، مۆسیقی، تابلۆ، دیزاین و نووسینی ڕازێنراوە، کار و بینای تەلارسازی، دیزاینی فەرش و ڕاخەر، پەیکەر و وێنە لە public domain لەم حاڵەتانەی خوارەوە:
    • ئافرێنەر(ەکان) زیاتر لە ٥٠ ساڵ لەمەوبەر کۆچی دواییان کردووە. (چاکسازی لە ماددەی ١٢ - ٢٢ی ئابی ٢٠١٠)
    • ئافرێنەر(ەکان) پێش ٢٢ی ئابی ١٩٨٠ کۆچی دواییان کردووە، بۆ ئەو بەرھەمانەی کە مافی چاپکردنیان پێش ٢٢ی ئابی ٢٠١٠ بەسەرچووە بەپێی یاسای ساڵی ١٩٧٠.
      • لە حاڵەتی بەرھەمەکانی نووسەری ھاوبەشدا، بۆ ھەژمارکردنی کاتی پاراستن، بەرواری مردنی دوایین نووسەری ماوە بە تەنیا لەبەرچاو دەگیرێت.
  • ماددەی ١٦: لەم حاڵەتانەی خوارەوە، مافە داراییەکانی نووسەر بۆ ماوەی ٣٠ ساڵ کار دەکات لە کاتی بڵاوکردنەوە یان پێشکەشکردنی گشتی: 1. کاری فۆتۆگرافی یان سینەمایی: 2. لە حاڵەتێکدا کە کارەکە ھی کەسێکە کە پێگەی یاسایی هەیە. "مافە داراییەکان" بە ئاشکرا مافی بڵاوکردنەوە و مافی وەرگرتنی پارەی تێدایە.
Copyright notes

Copyright notes		 Per U.S. Circ. 38a, the following countries are not participants in the Berne Convention or Universal Copyright Convention and there is no presidential proclamation restoring U.S. copyright protection to works of these countries on the basis of reciprocal treatment of the works of U.S. nationals or domiciliaries:
  • Eritrea, Ethiopia, Iran, Iraq, Marshall Islands, Palau, Somalia, Somaliland, and South Sudan.

As such, works published by citizens of these countries in these countries are usually not subject to copyright protection outside of these countries. Hence, such works may be in the public domain in most other countries worldwide.

However:

  • Works published in these countries by citizens or permanent residents of other countries that are signatories to the Berne Convention or any other treaty on copyright will still be protected in their home country and internationally as well as locally by local copyright law (if it exists).
  • Similarly, works published outside of these countries within 30 days of publication within these countries will also usually be subject to protection in the foreign country of publication. When works are subject to copyright outside of these countries, the term of such copyright protection may exceed the term of copyright inside them.
  • Unpublished works from these countries may be fully copyrighted.
  • A work from one of these countries may become copyrighted in the United States under the URAA if the work's home country enters a copyright treaty or agreement with the United States and the work is still under copyright in its home country.
Iran has enacted a copyright law which came into force on 12 January 1970 and communicated the official English translation to UNESCO on 20 April 1970.

ڕێککەوتنە دوولایەنەکان

ھەرچەندە ئێران بەشێک نییە لە پەیماننامەکان کە ئاماژەیان پێکراوە، بەڵام پێویستە ئاماژە بەوە بدرێت کە ڕێککەوتنە دوولایەنەکان لەوانەیە بەکارھێنانی سنووردار بکرێت. بۆ نموونە ئەڵمانی-ئێرانی "Abkommen zwischen dem Deutschen Reich und dem Kaiserreich Persien über den Schutz von Erfindungspatenten, Fabrik- oder Handelsmarken, von Handelsnamen und Mustern sowie von Werken der Kunst und Literatur" لە ساڵی ١٩٣٠ بەردەوامە. لەوێ وەرگێڕدراوە بۆ زمانی ئینگلیزی: "ئەو لایەنانەی گرێبەستیان ھەیە بۆ پاراستنی مافەکانی سەرەوە و ڕێوشوێنێکی گونجاو لە دژی پێشێلکارییەکان. لەنێوان ئەم مافانەدا ئەوانەی پەیوەستن بە ھونەر و ئەدەبیات (ھاوپەیمانان). بۆیە لە ئەڵمانیا پێویستە ئاستی پاراستنی ئەڵمانیا جێبەجێ بکرێت.

For coins and banknotes designed after 21 March ١٩٩٤ (current year minus 31 years) According to the 1970 Law for the Protection of Authors, Composers and Artist Rights, Iran banknotes and coins designed after 21 March ١٩٩٤ are copyrighted and their copyright belong to Central Bank of Iran.

Iran banknotes and coins are copyrighted and their copyright belong to Central Bank of Iran which is a "legal personality".

According to article 2 of copyright law of Iran (passed on January 1, 1970) architectural works, designs, sketches and buildings and sculptures of all types are protected by copyright law.

According to article 12 of copyright law of Iran, such works remain on protection for a period of 50 years (Reformation of article 12 - 22 August 2010) after the death of its author(s). Also according to article 13, copyright of the works which produced on order by an employer belongs to the employer for a period of thirty years from the date of production. In cases where the work belongs to a legal personality or rights are transferred to a legal personality, it will go into the public domain after 30 years from the date of publication or public presentation (Article 16).
