Category:Cultural heritage monuments in Xiva / Busts inside Ogahiy Museum

Infringement of sculptural copyright. There is no commercial Freedom of Panorama in Uzbekistan permitting us to freely host these images of two copyrighted cultural heritage objects from Khiva, Uzbekistan.

These busts inside a Khiva museum have description plates bearing the name "2019 Abdug'affor Isonaliev". The name appears in this document as a sculptor. All of these findings imply that the busts are 2019 works of an Uzbek sculptor, Abdug'affor Isonaliev. These images must be removed as infringing sculptural copyrights.

This work is not in the public domain in the US. A UK work with named living authors would have been in copyright in the UK in 1996 and thus have been restored under the URAA. It would leave copyright in 2027. There's also no evidence that it is currently in the public domain in the UK; there's a list of seven (non-Aristotle) people on the title page, and death years for none of them, which makes it a pretty big assumption they all died before 1955. These images depict the monument to Amir Timur in the Uzbek city of Shahrisabz as the main/intended subject. The statue dates to 1996, so too recent to be out of sculptural copyright. Since there is no commercial Freedom of Panorama in Uzbekistan, Wikimedia Commons cannot host freely-licensed images of this monument like these.

Tashkent TV tower was built in 1984. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for a certain period (usually 70 years) of time after the death of the creator (be it the last-surviving architect, engineer, designer, sculptor, engraver, or painter). An image of a work that is still under copyright is considered as a derivative work, and infringes on the copyright so therefore we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception Commons:Freedom of panorama (FoP). Unfortunately, Uzbekistan has no Commons-acceptable FoP.

The author isn't anonymous - "Fine Arts Professor John Simpson designed a simplified version of Canterbury College's arms and it was duly approved and authorised by the English Kings of Arms in Letters Patent dated 10 May 1965."(link). So, 50 years since publication date not applicable.

Looking at the definition of applied art, I don't think this is applied art. Also that bit is just from the infobox, text of the advice there says it applies to typographical work which this isnt TheLoyalOrder (talk) 12:03, 7 May 2025 (UTC)
Hm. Graphic design (like we have here) usually is considered to be applied art, and the protection of typographical arrangements is something different (it's about book editions where the work itself is in the public domain). But looking at en:Copyright law of New Zealand, that applied art bit from the infobox probably refers to “Artistic craftsmanship industrially applied” (protected for 25 years from when the work is applied), which this coa is not. Upon further investigation, it is very unlikely this photo is Public Domain. After many emails with various departments and organizations, I was able to track down the origin. It comes from the 1983 Alberta Order of Excellence. The photo is not from 1970. As can be seen here: https://www.flickr.com/photos/104988456@N08/50011349482/in/album-72157714727340453/. Library of Parliament also acknowledges it comes from an outside source; the AOE, and is unclear about the copyright status, claiming it is Public Domain but the AOE appears to claim it is copyrighted. Nobody was able to provide with a clear source or any evidence it is 100% Public Domain, purely word of mouth. I believe this may be an error. As ParlInfo/House of Commons is not the copyright holder, I am not sure if their PD claim on their site can be trusted. I will show some of the email correspondence below;

The photo of the Right Honourable Joe Clark found in the Parlinfo database is from an outside source in the public domain which has been adapted to fit the database’s parameters; as such, we do not have copyright information on this image. Upon verification with the Parlinfo database management team, they believe the photograph of the Right Honourable John Turner is from circa 1983-84, but they have limited information about the image itself.
Alberta Archives
Thank you for contacting the Provincial Archives of Alberta. The Provincial Archives has images of the 1983 Order of Excellence Awards Ceremony at Government House (in the Public Affairs Bureau photographs, GR1994.022/13854-56), but I cannot find individual images of the award winners. I would suspect they might still with the Order of Excellence office.

I still await an email from the AOE, however based on the public evidence this is most likely a copyrighted photo with no real proof its Public Domain. Still too recent for any copyright expiration, under {{PD-Canada}}. Should be deleted per COM:PRP for now, until future evidence emerges or the copyright expires. However, it is most likely a Crown work which would mean its actually PD in 2034, per {{PD-Canada-Crown}}.

I see from the school website (linked to on the page) that they've had a change of official logo in the last ten years, but the logo can be seen in a past staff newsletter Logan Park High School (the eighth citaton in the reference section of the school's Wikipedia article). I oppose deletion. The statue was erected in New York City three years ago, meaning it is definitely copyrighted under the current 1976 Act. Not just that, the photo of the statue itself doesn't have freedom of panorama in the US, in contrast to other copyrighted statues in their source countries like the United Kingdom being given such freedom. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ukraine.

As fotografias em causa são todas da minha autoria, mas como na ocasião em que as publiquei não tinha acesso aos ficheiros originais e era iniciante na Wikipédia usei ficheiros sem metadados e sem grande qualidade, e as datas que aparecem não coincidem, o que não ocultei. Veja-se por exemplo que na segunda supra foto escrevi na legenda, «Maria José Gama, na sua casa de Cascais, com Manuel Alegre, 2007», data que está impressa na própria foto. Das falhas cometidas, peço desculpa e comprometo-me que não se voltarão a repetir. Estou disponível para substituir as fotos por outras, se for julgado por necessário. As outras cinco fotografias foram tiradas por mim in loco, e, quando fotografei pessoas, fi-lo com o consentimento dos visados (Maria José Gama, Manuel Alegre e Maria de Belém Roseira). Relativamente às fotos da «Lápide» e da «casa de Joaquim Carvalho dos Santos» (em cuja fachada está a lápide em causa), esclareço que apesar de ambas terem sido tiradas por mim, em Almeida (Portugal) a 28 de maio de 2023, como, no momento da publicação, só as tinha comigo em versão papel (isto é impressas) para as incluir em artigo da Wikipédia fotografei as mesmas com o meu telemóvel/celular. Acresce, tratar-se de «Building over 150 years old in Almeida (Portugal - country with freedom of panorama)». A criação destas cinco fotos é, importa reafirmá-lo, da minha inteira autoria. Authorship and date of this image is not clear. At Commons:Help desk/Archive 1#Uploading picture of my late grandfather, uploader says "He retired in 1963 and I believe the picture was taken around that time", but the mage is now dated 1952. It is also not clear that the subject is also, as claimed, the photographer. At en:User:ClaireKamala/sandbox they say Wood died in 1984, but the image has been uploaded as "{{PD-old-70}}", which would only apply if Wood (or whoever is the photographer) died before 1955.

@Mitte27: The CC-By 4.0 license allows anybody to use the photo providing that the reuser atributes the author. Thor photo author is the photographer. Администрация городского округа Пушкинский Московской Области is not the photographer. So using the photo in Commons (without author attribution) is copyright violation. CC-BY license provides no exception for attribution. If the photographer is properly attributed, we can host the photo. But who the photographer is? "Our public licenses are intended for use by those authorized to give the public permission to use material in ways otherwise restricted by copyright and certain other rights.". If the institution is the copyright holder, which is possible for a company that employs photographers, why can't they assign the license with whatever attribution they want? It would be very strange if companies had to make attribution for works they own the copyright on to the individual authors rather than the company itself.  REAL 💬 ⬆   21:54, 7 May 2025 (UTC)
If they do not want to attribute the author, why do they use a license that requires attributing the author? I do not see any attribution there. Also (at least in some jurisdictions) the roght to be attributed is moral rigth of the author that cannot be transferred to a third party like copyright. So the copyright holder may be not allowed to use whatever attribution they want without author's permission. However, if the copyright holder declares a specific attribution, we can rely that they are allowed to do so. Can you see any attribution requirement in the source service? If there is no specified attribution it is reasonable to conclude it should be the name of the institution. According to https://creativecommons.org/licenses/by/4.0/legalcode.en#s3, attribution to the original creator is only necessary if "it is supplied by the Licensor with the Licensed Material".  REAL 💬 ⬆   22:46, 7 May 2025 (UTC)

Наглая ложь. Вот источник. В этом источнике не испольузются выделения цветом какого либо района, как это сделал я (я выделил зелённым район под номером 21). Кроме того я существенно улучшил качество изображения. Не говоря о том что всё это я делал не на полной карте а на ей фрагменте. There is very clear reason to believe that it DOES qualify as Template:PD-textlogo, and is NOT a derivative work. Given that the majority Wikimedia Commons users speak English, or at least speak a language that uses latin characters, it is understandable that it is hard to discern the validity of the application of PD-textlogo to Arabic.
Concerning Template:PD-textlogo, if the image is broken down, there are three parts; the top text, the main text and the little text in the middle. The top text (لقد وجدوا في الله أن جهادهم الحقيقي هو السلام) reads "They have found in God that their true jihad is peace." This is from Surah Al-Hajj (22:78). The main body text (حركة النجباء) reads "Harakat al-Nujaba." The little text in the middle (الله) reads "Allah." If the argument is that it isn't simple enough to constitute PD-textlogo, it's written in caligraphy, which per Section 906.4 of the Compendium of U.S. Copyright Office Practices, is not copyrightable.

Thank you for the explanation. I have searched Commons for prior discussions on this topic, and I have found out that DR outcomes regarding calligraphy are quite variable. For example (also from Iraq), the logo of the Popular Mobilization Forces has been deleted several times: 1, 2, 3.
It is noteworthy that, for an image to be kept, a PD status in the US is not enough – it also needs to be in the PD in the source country. I agree though I am not competent to judge whether particular instances of Arabic calligraphy are original enough, so I would welcome a comment by an uninvolved editor competent in this area. Until then, I am going to leave this DR open.

Thank you for getting back to me. I believe that it falls under PD in Iraq due to Article 6 of Law No. 3 of 1971 on Copyright, which states that official documents are exempt from copyright (for which flags fall into this category; which is just one of the reasons why the national flag of Iraq can't be copywritten). The militia for which the flag belongs to is apart of the PMF, which legally is apart of the Iraqi Armed Forces, meaning that Article 6 extends to this militia.
The flag also falls under PD in Iraqi because it is an "anonymous work or pseudonymous work," The militia operates in this fashion due to security concerns, as the group is considered to be a terrorist organization by the US, and since it likes to fire rocket/missiles at Israel. It is indeed possible that the PMF flag was deleted errorneously for the reasons you have given.
The flag also falls under PD in Iraqi because it is an "anonymous work or pseudonymous work," – If I understand you correctly, you are refering to Article 21 of the 1971 law. This article was suspended in 2004. (Page 5 of the PDF, point 12.) Template:PD-Iraq also does not mention that pseudonymous works would be in the PD in Iraq.
The militia operates in this fashion due to security concerns, as the group is considered to be a terrorist organization by the US, and since it likes to fire rocket/missiles at Israel. – I have searched discussion archives, and I do not see that there is a consensus to consider works by illegal organizations uncopyrightable. (There has been quite a lot of discussions, but here is a recent example, and here is a less recent one.)
Speaking of copyrights of illegal organizations, Commons has, e.g., {{PD-PCP-SL}}, but there apparently is concrete legal reason for the template. (At least it looks like that; I am not a lawyer.) In spite of this, the use of this template is not without controversy.

I've done some research on the group, Asa'ib Ahl al-Haq, and I've always thought it was a little strange that this file was used for the group's page; it's not their logo.
