L'auteur est présent sur la photo. Pour cette, son large sourire serait apprécié devant les tribunaux comme un accord tacite de l'auteur lui-même devant son croquis signé de sa main. Cette photo a été réalisée lors d'une exposition en publique. Wiki se veut plus royaliste que le roi, du moins certains régulateurs se veulent justiciers. If this work is from Portugal, it should be kept as it is in the public domain in both Portugal and the U.S. Under Portuguese law, photographs taken before 1970 are public domain after 25 years, meaning this photo's copyright expired by 1991. U.S. law does not restore copyright for works already in the public domain in their source country by 1996, so the photo remains free in both countries. This image has been deleted previously. Flickr user states it is a slide in their collection, not own work. They note on flicker that the slides come from "Probably 95% come from slides, the remaining 5% are prints or negatives. They include my own Kodachrome slides, as well as other photographers, which are noted accordingly when the identity is known. All have been collected over the past 40+ years of shooting, exchanging, and purchasing. I was fortunate enough to trade with some of the best aircraft photographers in the world." See and where they describe their collection. If they are not the original photographer they can't license the image as CC-by-2.0 (Dual Freq).     In Commons we care about country of origin and that is determined by the first place it was published. That is, it is irrelevant for Commons if an image is PD in according to the Italian legislation if Italy is not the country of origin. It is even explicit in the first sentence of {{PD-Italy}}: The country of origin of this photograph is Italy. . The link goes to the Berne Convention definition of country of origin. Now, if the country of origin is indeed Italy as claimed in the file, then as I mentioned URAA applies, or do you have a proof that image was published simultaneously in the US?   •  Delete This photo, taken by the Associated Press (AP) in 1987, is likely under U.S. copyright, as AP is a U.S.-based agency and their photos are typically works for hire with a 95-year copyright term from publication. AP's standard practice involves from what I've ever seen including credit lines on their images (such as at least "John Smith/AP"), making it highly unlikely that the photo was published without notice prior to 1989, thus maintaining copyright in the U.S. until at least 2082. Even if the image was first published in Italy, which has not been proven, it would have been protected there until 2007 under Italy’s 20-year-from-creation rule. However, under URAA, the photo's copyright would have been restored in the U.S. because it was still protected in Italy as of January 1, 1996, extending its copyright protection to 2082. --Jonatan Svensson Glad (talk) 00:42, 4 May 2025 (UTC)
