File:Hayakawatani.jpg

Speedy deletion challenged to ask the question of whether this photo might be in the public domain. This file was initially tagged by Menakei as no permission (No permission since) Ikan Kekek (talk) 03:13, 3 July 2025 (UTC)

Whether it is in the public domain in the United States depends on when and where it was first published:
  • If it is a previously unpublished photo, then it is copyrighted per COM:SC.
  • If it was previously published somewhere, then there are two rules: the URAA rule and the subsisting copyright rule, where either rule may make the photograph copyrighted in the United States. For the URAA rule, you need to identify the country of first publication (which was not provided by the uploader). For the subsisting copyright rule, you need to identify the exact publication where the photo was first published. --Stefan2 (talk) 21:46, 3 July 2025 (UTC)
  • USA copyright case law declares that when an image leaves the custody of the creator, it has been "made public". See: Commons:Deletion requests/File:Minerva Kohlhepp Teichert 1908.jpg for the relevant citations. --RAN (talk) 17:36, 4 July 2025 (UTC)
    • Who is the creator and has it left the custody of this person? If so, when did this happen, and did this person impose any restrictions on the use of the work? Also, what is the source country of the photograph? The only information that the uploader provided was that the uploader took the photo himself in 1930 (which is not a credible claim). --Stefan2 (talk) 19:13, 4 July 2025 (UTC)

File:Iain McCaig headshot cropped.jpg

First indexed on April 3, 2011 on Tineye, uploaded in 2016: needs proof uploader is photographer Bremps... 04:56, 3 July 2025 (UTC)

Hi Bremps,
The copyright in the photograph in question belongs to me, Iain McCaig. I use it as one of my main publicity photos.
'ByronMarks' is a fictious character--an Interviewer--that I invented for my book, 'Shadowline: The Art of Iain McCaig'. On the Wiki page, the attribution credits the photo to him. I do not know why that name is being used here, other than it is rather witty. To be strictly accurate though, the photo should be re-attributed as follows: 'Copyright 2025 Iain McCaig'.
In any case, I do give Wikipedia the right to use this image on the 'Iain McCaig' Wiki page.
Cheers,

New user claiming to be foucalt- i think we need VRT

Gbawden (talk) 11:12, 3 July 2025 (UTC)

Hello @Gbawden,
Answer in french in this discussion page.
She says she has known Renaud Cestre for 20 years. When I told her that the © on the picture was not a reality in commons, she said that she « gives up » her copyright on the picture.
I have no idea how commons work and if it is sufficient, thank you for all the work you are doing behind the scenes.
Sincerely, TTSolitaire (talk) 17:57, 3 July 2025 (UTC)
Well, is there a reason to doubt? If the person is a professional photographer, VRT could indeed be useful, although not really necessary for this particular photo if it was never published elsewhere before on Commons. It would be useful also to confirm if the accounts User:Mélanie Foucault 3 and User:Mélanie foucault are owned by the same person, as it seems. -- Asclepias (talk) 18:36, 5 July 2025 (UTC)

This appears to be copyrighted. Usage terms in the metadata say "No reproduction without prior permission!" and we don't appear to have permission. - Chris.sherlock2 (talk) 15:36, 3 July 2025 (UTC)

Keep if I go to their collections page, click the image and then click 'Reuse image', it says it's licensed under CC BY-SA 4.0. Interestingly enough if I download it from there, I still find the metadata saying all rights reserved... applecuckoo (he/him) 03:10, 4 July 2025 (UTC)

All files have a "self" license, yet the EXIF has three different authors mentioned. They are taken by 4 different cameras. The files with aerial views have no exif information, but one of them was used by the center that it depicts as a Christmas message in 2022.

User with bad history, various coats of arms and small images without EXIF, unlikely to be own works.

Yann (talk) 18:12, 3 July 2025 (UTC)

I’m devastated to see this deletion request for my contributions. These works, every coat of arms, every image, are my own creations, poured from my heart and countless hours of effort. This isn’t just a project for me; these edits are my life’s passion, a way to share knowledge and preserve history. To have them labeled as “unlikely to be own works” without any prior discussion feels deeply unfair and discouraging.
I want to be clear: I own all of these images. I created them myself, and I’m ready to prove it with screenshots of my computer, original files, or any verification you need. The concern about missing EXIF data or “bad history” doesn’t change that these are my original works. EXIF data can be absent due to editing tools or file compression, but I assure you these are mine. If there were doubts, I wish you had reached out on my talk page first. I’d have gladly addressed any questions or provided evidence to resolve this.
Please reconsider this deletion. These contributions mean everything to me, and I’m committed to meeting Wikipedia’s standards. I’m happy to work with you or an admin to verify ownership or make any needed changes. Let’s talk this through so we can find a solution without erasing my work. Thank you for understanding. Repair it (talk) 18:52, 3 July 2025 (UTC)
Hello @Repair it,
You say these files are your own work, but what about this one, for example?
It looks like a photography of a book, isn't it? We can even see some texture in the background. Did you really create it from scratch? Daehan (talk) 14:31, 11 July 2025 (UTC)
This deletion discussion is now closed. Please do not make any edits to this archive. You can read the deletion policy or ask a question at the Village pump. If the circumstances surrounding this file have changed in a notable manner, you may re-nominate this file or ask for it to be undeleted.

This file has been on Commons since 2012, presumably having passed license and source checks at the time. If it's now considered a copyright violation, could someone clarify what new evidence or policy change has prompted this reassessment? Wouldn’t such concerns typically have led to earlier deletion. ItsShandog (talk) 09:45, 4 July 2025 (UTC)
I am a bit surprised that such an obvious media/promo photo has lasted so long without appropriate evidence of a free license, typically they are caught sooner. If it had passed some license verification before, the evidence would be attached to the file (eg a license reviewed template, VRT ticket, or ‘kept’ DR discussion). There’s no grandfather clause in COM:EVID for old files. Edit: actually there is COM:Grandfathered old files but it isn’t relevant to this case. Consigned (talk) 13:53, 4 July 2025 (UTC)

Too many times its elimination has already been requested in the past: to protect the logo, there is, in addition to the PD-Textlogo license, also the TOO-Italy where, the brands of teams and in general of high fame and with an objective complexity, are not protected, as is the case of that of Trapani. The logo itself is easily reproducible: an anchor in half, some squares (which are the bricks of the castle, equally reproducible), sea waves and the shape of the logo make it something very easy to copy objectively even finding on the Internet or with very basic shapes  Preceding unsigned comment added by Giov.c (talk  contribs) 21:49, 3 July 2025 (UTC)

Question: Regarding Special:Diff/1054580691, under what filename(s) was it previously deleted?   — 🇺🇦Jeff G. please ping or talk to me🇺🇦 14:12, 9 July 2025 (UTC)
  •  Delete. (e/c) The castles are not simple geometric shapes, so the license claim is wrong. The castles are enough to put the logo above COM:TOO-US. FC Trapani has been around since 1905, so the logo may have aged into the public domain. However, I could not find a date for this logo, or a history of Trapani's logos, so I cannot assume it has aged out. It also has a modern appearance. COM:PCP implies delete. Some Wikis can host the image under fair use, but not Commons. Glrx (talk) 14:17, 9 July 2025 (UTC)

This logo was completely revamped last year for the 2024/2025 season.
There have been others in the past, but this one is the most recent. 109.52.2.201 14:34, 9 July 2025 (UTC)
It's not recentism that should force the logo to be removed. However, castles, even if declared above TOO-Italy, are easily reproducible, I repeat. It takes nothing to find castle drawings on the internet and reproduce them, like this, just like waves. Giov.c (talk) 16:12, 9 July 2025 (UTC)
If it can be reproduced so it looks the same, fine, but if it's going to be a fake logo, it might as well be removed.
I don't understand why many other sports club pages don't raise any issues, but here they do.
But obviously, I'm speaking as an ignoramus. 109.52.2.201 17:08, 9 July 2025 (UTC)
