The rights to promote and publish her work was transferred at the same time. I request the deletion of our image from Wikipedia for the following reasons: 1. After META announced that it wanted to use Instagram content for AI purposes, we contradicted this. In addition, we have deleted all posts and pictures that show us and our artworks from our Instagram account. 2. Since there are more and more misuses of images, e.g. for AI purposes and even worse for deep fakes, we have also removed the image to be deleted here on our website. 3. Die Gemeinde, die das Hausrecht in der Marienkirche in Barth ausübt, erlaubt Fotografien im Inneren nur zu privaten Zwecken und verbietet die Vergabe von Nutzungsrechte an Dritte, was im Eingangsbereich der Kirche auch sehr deutlich gekennzeichnet ist. Eine Lizenzierung unter CC BY NC SA oder gar CC BY SA ist damit nicht zulässig. The only thing I don't understand now is why some files have been deleted and others are labelled as possibly being kept. The basis is the same for all photos from the 1940s. The user who uploaded them apparently has the right to deal with the photos. But he is definitely not the photographer of the pictures. And the question now is how we deal with copyright. 1. In my opinion the family is not the rights holder in case of copyright questions.
2. In de-wp you told the photographer (at least the studio where the pictures were taken) are known to you. This is contradictive.
3. Besides the question of copyright violations (which isn't that easy as you say), you were faking informations in metadata.
4. The opinion that the photos were historically significant is your own opinion. I don't share this.

I see it the same way. They are significant for the person of Franz Pöschl, but not from a historical perspective. That's why I said that a picture of Pöschl in every rank and with every single medal awarded does not have to be uploaded here and, above all, does not have to be included in the article. That's not our problem. Some starlets have more than one photo, and how many images someone slaps into a person article isn't a matter for Commons, but rather for the language versions. If someone installs a picture of Joe and Jane in an article about Jane and Joe and everybody not care about, that's not our problem. Da mein Englisch nicht so perfekt ist, schreibe ich auf Deutsch, füge aber eine Google-Übersetzung bei.

Den Löschanträgen war ein Thread auf Anfragen für Adminstratoren in der deutschsprachigen Wikipedia vorausgegagnen de:Wikipedia:Administratoren/Anfragen/Archiv/2025/Juni#Versionslöschungen_in_Franz_Pöschl. Ich hatte mich dann an folgender Hilfe-Seite orientiert File:DEU_Tutorial_-_Hochladen_von_Bildern_neu+Commons.svg;

Weitgehend zeigen die Bilder eine Person, und zwar Franz Pöschl selbst. Da dieser verstorben ist, kann er selbst der Veröffentlichung nicht mehr zustimmen, sondern dieses Recht ist auf seine Erben übergegangen. Auf der Benutzerseite des Hochladers de:Benutzer:Stout1988 befindet sich eine Erklärung, dass er im Auftrag der Familie handelt. Ggf. könnte der Hochlader die Zustimmung der Erben = Familie an Commons via VRT senden, wie oben von ihm angeboten.

Gravierender erschien mir das zweite Problem. Da die Fotos ja ein Fremder aufgenommen haben muss, ist dieser der Urheber des Bilder mit entsprechender Urheberrecht. Ich war dann davon ausgegangen, dass dieser nicht bekannt sei. Nach dem ganz rechten Weg auf der Hilfe-Grafik müsste dann das Bild älter als 100 Jahre sein, also vor 1926 aufgenommen sein, was definitiv bei keinem Bild der Fall ist. Daher meine Löschanträge.

In dieser Diskussion war auch die Rede von einer Frist von 70 Jahren. Laut der Hilfe-Grafik greift diese nur, wenn der Urheber bekannt ist und vor mehr als 70 Jahren verstorben.

Sofern ich die Grafik falsch verstanden habe und mehr als 70 Jahre alte Bilder, also Bilder, die vor 1956 aufgenommen wurden, hochgeladen werden dürfen, berücksichtige ich das selbstredend bei künftigen Meldungen. Dann wäre eine Löschung aller oben aufgeführten Bilder nicht erforderlich, VRT Meldung vorausgesetzt.

The deletion requests were preceded by a thread on administrator requests on the German-language Wikipedia de:Wikipedia:Administratoren/Anfragen/Archiv/2025/Juni#Versionslöschungen_in_Franz_Pöschl. I then referred to the following help page File:DEU_Tutorial_-_Hochladen_von_Bildern_neu+Commons.svg;

The images largely depict a person, namely Franz Pöschl himself. Since he has passed away, he can no longer consent to their publication; this right has been transferred to his heirs. On the uploader's user page de:Benutzer:Stout1988, there is a declaration stating that he is acting on behalf of the family. If necessary, the uploader could send the heirs' consent (= family) to Commons via VRT, as he offered above.

The second problem seemed more serious to me. Since the photos must have been taken by a stranger, they are the author of the images and therefore hold the corresponding copyright. I assumed that this person was unknown. Following the right path on the help graphic, the image would then have to be older than 100 years, i.e., taken before 1926, which is definitely not the case for any image. Hence my deletion requests.

This discussion also mentioned a 70-year limit. According to the help graphic, this only applies if the author is known and died more than 70 years ago.

If I misunderstood the graphic and images more than 70 years old, i.e., images taken before 1956, are permitted to be uploaded, I will of course take this into account in future reports.
