File:Alan Kurdi Graffiti.jpg

I brought this image of a graffiti to COM:VPCOPY, hoping to be wrong about whether the graffiti is the derivative of one non-free photo. As it turns out, despite FOP given to artworks in Germany, the graffiti may be a derivative of multiple non-free photos of the same corpse found on a beach. One assumes that the graffiti is not a "derivative" because it doesn't exactly copy one of the photos or more. Another disagrees under assumption that even requirement for the graffiti to be this non-free derivative may be very, very minimal. Taking this to DR was suggested, so here I am doing this. George Ho (talk) 02:23, 25 April 2025 (UTC)

Who assumed, who disagreed, who suggested and where can I find this discussion? --Plenz (talk) 07:50, 25 April 2025 (UTC)
Carl Lindburg assumed and suggested; Grand-Luc disagreed. Either tap "COM:VPCOPY" or the following for further more: Commons:Village pump/Copyright/Archive/2025/04#File:Alan Kurdi Graffiti.jpg. George Ho (talk) 07:56, 25 April 2025 (UTC)
Thank you very much. So, all in all, the whole initiative came from you. I wonder what was your motivation. As for me, I am a determined enemy of preemptive obedience.
Anyway, let's find a solution.
Would you be satisfied if I change the red skirt into a green one and add a comment "For copyright reasons, the original red color of the shirt was changed"? --Plenz (talk) 08:19, 25 April 2025 (UTC)
preemptive obedience: Never heard of that before, so I'm looking at wikt:anticipatory obedience.
Your question doesn't address who owns the red skirt and whether photos of the red skirt have separate copyright different from the red skirt itself. COM:DW addresses matter of derivates, and COM:FOP US and COM:FOP Germany have different stances on freedom of panorama. I can't help wonder whether this is the complex question (fallacy?). George Ho (talk) 08:38, 25 April 2025 (UTC)
My question addresses your motivation for your deletion request. You're trying to assume the photographer's presumed future role and discuss presumed future arguments for deleting the photo. If you were that photographer yourself, I could understand your motivation. But you're not him. This matter could be completely irrelevant to you. That's why I have absolutely no desire to delve into the intricacies of various copyright laws. --Plenz (talk) 20:34, 4 May 2025 (UTC)
But you're not him. One of the photographers is a woman. This matter could be completely irrelevant to you. Don't know why you assume so. Besides using photos, how else can a graffitist/muralist depict that dead boy lying on the ground?
"Motivation"? Besides COM:PCP, I just don't want the project to be receiving legal challenges just for hosting this image. Also, before taking the image to DR, I initially didn't intend to nominate the image for deletion. Indeed, I took this to COM:VPCOPY as a precaution... or precursor to this DR nomination, hoping that others would've deemed the image free to use. However, the opinions were split/divided there, so I took this image here instead, citing laws and project policies and photographers' (or photographer's) rights of the photos, and hoping for any other opinions, like yours. This was sticker art, not graffiti, and no FoP for 2D works in USA A1Cafel (talk) 03:12, 25 April 2025 (UTC)

  •  Weak keep This looks like a stenciled sticker created by street artist as opposed to a commercial product. So there wouldn't be other copyright concerns. It's also placed in a public place in a way that breaks the law. Meaning there's very little chance the artist themselves will sue anyone for reusing it. That said, I wouldn't be super upset if the image is just deleted. But I don't see why the same rule for regular graffiti wouldn't apply here. --Adamant1 (talk) 03:55, 25 April 2025 (UTC)

Non-free logos. Calligraphy is copyright protected per COM:TOO China.

Wcam (talk) 13:44, 25 April 2025 (UTC)

  •  Keep for File:BTV 1958.png. In fact, the old Beijing Television (CCTV predecessor) logo was made in 1958, 67 years ago. Assuming that Wcam argue that calligraphy is copyright-protected in China, this one had its copyright expired more than a decade ago (Remember, China had 50 years copyright protection for many works as opposed to life+70 years in many developed countries), so (PD-PRC) might be apply for this case, no matter whether it above TOO in China (which is very low).  Delete for the rest. 114.4.214.189 13:04, 3 May 2025 (UTC)
Copyright protection duration in China is indeed 50 years, but its US copyright was restored per COM:URAA (on the restoration date of 1 January 1996 which is within the 50 year duration). Images must be free in both the US and country of origin to be hosted on Wikimedia Commons. Wcam (talk) 14:27, 3 May 2025 (UTC)
  •  Delete for
Keep for File:BTV 1958.png. Strictly speaking, this is older version of calligraphy that its protection in China expired long time ago (assuming that this is not government work). In the United States, according to section 906.4 of the Compendium of U.S. Copyright Office Practices, typography and calligraphy cannot be protected by copyright in the United States, so the Chinese calligraphy cannot be protected by copyright in the US (hence URAA), or no evidence that this work was registered in the US before. Remember, just saying a file is URAA cannot be a sole reason for deletion. More than a proof needs to justify it. 2404:8000:1037:469:A56B:968E:1C04:B235 23:35, 3 May 2025 (UTC)
Comment, according to the image description and w:zh:中国中央电视台台标#文字台标时期, the calligraphy in File:BTV 1958.png is written by Mao Zedong, which passed away in 1976. •  Speedy keep Actually, the uploader who upload this image didn't know about which the license are correct for this logo, because the uploader originally upload the image as an incorrect license (CC-BY-SA 2.5). It seems that the someone fix the license to correct one (as PD-Textlogo), and just the copyright info was revealed at websites doesn't mean that this logo was copyrighted (it also happened on all websites, well most of them also include simple logo that doesn't meet TOO), it's just disclaimer. Anyways, this logo doesn't meet threshold of originality in the country (remember TOO-South Korea), due to this logo being simple just consisted of letters and circles. 2404:8000:1037:587:AC39:61BE:A474:7350 09:51, 5 May 2025 (UTC)

No license, no permission, complex logo exceeding COM:TOO Taiwan. Logos of state owned enterprises aren't government works (see Commons:Deletion requests/File:CSBC Corporation logo.svg). Wcam (talk) 15:48, 25 April 2025 (UTC)

  •  Delete In order for Commons to keep this file, it's going to need to either need to be too simple to be eligible for copyright protection in both Taiwan and the US, or it's going to need to be released under an acceptable free license per COM:L. While this logo probably is OK to treat as {{PD-logo}} per COM:TOO US, the same can't be said per COM:TOO Taiwan. Moreover, there's nothing to indicate that the logo has been released by it's original copyright holder, including what's written on page linked to above by Sinsyuan. This probably would be OK to undelete on English Wikipedia and relicense for local use as en:Template:PD-ineligible-USonly. It could also certainly be licensed as en:Template:Non-free logo on English Wikipedia if the consensus is that it's too complex to be PD even under US copyright law. In that case, though, there would be no way for the file to be used in so many articles or used in templates per en:WP:NFCC, and the only vaid non-free use would be in en:New Taipei Metro. -- Marchjuly (talk) 06:31, 26 April 2025 (UTC)
  • Keep I think... These look like VERY simple shapes/typefaces. However, if deleted on commons, I would request re-opening on en-wiki. The whole reason for deletion is that it was available here. Buffs (talk) 19:00, 28 April 2025 (UTC)
Let me add to that. Near as I can tell this is nothing more than a stylized "N" or something similar. Even in Taiwan, I don't think it's copyrightable. I think TRADEMARK would apply and would get some protections, but not copyright. From looking at the examples in COM:TOO Taiwan, I'm not convinced this is eligible. HOWEVER, they appear to be inconsistent (I don't know local culture there, so I'm open to the possibility that I'm missing something). My  Keep stands. Buffs (talk) 18:07, 1 May 2025 (UTC)
TOO is very inconsistent in Taiwan, yes, see wikipedia:Threshold of originality#Taiwan. Saimmx (talk) 17:18, 20 June 2025 (UTC)
  •  Weak keep per Buffs. I believe simple logos like this one are ineligible for copyright in the United States or countries where threshold of originality are roughly similar or higher than the US. In case of this file deleted from Commons (assume TOO-Taiwan applies for this case), we can undelete similar file at En-wiki and stated that the file is PD-Ineligible-USOnly. In any case, there's no evidence that this file can be put at local en-wiki as "fair use", even the source stats "© New Taipei Metro Corporation. All Rights Reserved". Remember, the copyright tags only apply for Taiwan in case of this logo, not so for the US or other countries where threshold of originality for logos are higher. 120.188.4.166 06:13, 1 May 2025 (UTC)

Yes, there is. There is no way to claim de minimis when the photograph obviously focus on the newspapers. Its title says it all. RodRabelo7 (talk) 14:19, 26 April 2025 (UTC)
Keep there are plenty of photos in wikimedia regarding newspaper covers, most of them even with text visible and readable. in this photo, most of the text is censored, and I decided to leave readable only the titles about the pope. I don't see any copyright issue, but I'll let others decide. LANCIAY 1 (talk) 19:55, 26 April 2025 (UTC)
Then nominate them to deletion, because they should be deleted as well. RodRabelo7 (talk) 20:03, 26 April 2025 (UTC)

File:Pinkfong logo.svg

This file was initially tagged by Headlock0225 as Copyvio (copyvio) and the most recent rationale was: Source, web and youtube site given, is marked "ⓒ The Pinkfong Company. All Rights Reserved"  REAL 💬   19:17, 25 April 2025 (UTC)

The video uses the Creative Commons Attribution (3.0 Unported) license option on YouTube as does hundreds of other videos by Pinkfong across multiple channels. The copyright owner can distribute it under as many different terms as they want. Similarly several videos by Warner Bros and Bandai Namco with the CC license contain "All Rights Reserved" within the videos itself but no one has used this as a deletion reason (Commons:Deletion requests/Files in Category:Videos by Bandai Namco, Commons:Deletion requests/Files in Category:Hogwarts Legacy)  REAL 💬   19:25, 25 April 2025 (UTC)
Weak keep due to channel uploader having verified status, although not sure if the CC license applies to the external SVG. SergioFLS (talk) 01:10, 18 May 2025 (UTC)

File:Arthur Herbert Thompson with his milltary uniform (colourized).png

possible copyvio - feasably still within the copyright term of a british photographer given a estimated year of 1915 when this was taken and british copyright being life + 70 TheLoyalOrder (talk) 21:41, 25 April 2025 (UTC)

As I and TheLoyalOrder have discussed externally, the photographer seems to be a soldier which under COM:CROWN would make Public Domain, so I request until we figure out if it's Public Domain or not, don't remove the two images. Crispybeatle (talk) 22:35, 25 April 2025 (UTC)
Just to clarify from that conversation, we don't know anything about the photographer so can't just assume they're a soldier. TheLoyalOrder (talk) 23:44, 25 April 2025 (UTC)
Could the file still be hosted locally on enwiki? Howardcorn33 (talk) 22:09, 4 May 2025 (UTC)
it's unclear whether this photo was published when it was taken or not (could be from a private photo collection). to be on en:wiki it would have to be out of copyright US so published over 95 years ago. TheLoyalOrder (talk) 22:40, 4 May 2025 (UTC)
ww1 was over 100 years ago Crispybeatle (talk) 15:37, 6 May 2025 (UTC)
year of publication =/= year of creation necessarily TheLoyalOrder (talk) 20:06, 6 May 2025 (UTC)
I got a response on the Sevenoaks School archivist. She said that it was possibly made by Charles Essenhigh Corke. In fact, here is a portrait of another soldier taken by Charles: https://sevenoaksww1.org/wp-content/uploads/2016/08/image4.jpeg with an almost identical border to the original picture. Crispybeatle (talk) 12:02, 8 May 2025 (UTC)
Charles also died in 1922 which would make it copyright free. Crispybeatle (talk) 12:29, 8 May 2025 (UTC)
That should settle it in favor of keeping then. Howardcorn33 (talk) 12:24, 28 May 2025 (UTC)

File:Go Back to Alaska Sarah Palin, 2008 - Larry Fulton Postcard (5335891606).jpg

Copyright violation? Confusing entry on Flickr - permission required to reproduce is contrary to the cc-by-sa licence given. Besides it seems to be a Derivative Work . Are all the images by Fulton and if so why is Fulton not the copyright holder. Headlock0225 (talk) 21:47, 25 April 2025 (UTC)

  •  Delete I was actually trying to avoid uploading postcards by Fulton. One must have snuck in though. Feel free to nominate any others you see in my uploads for deletion. --Adamant1 (talk) 21:51, 25 April 2025 (UTC)
