Probable copyright violation despite the previous DR ending in keeping the image. I claim that the Pokémon illustrations are not COM:De minimis. Per our policy, one can do some checks with Commons:De minimis#Guidelines:
- this image is used to illustrate the articles about en:Pikachu (seen on the front left to the door) and en:Bulbasaur (seen on the back, right to the door)
- the image is categorised in relation to several Pokémon characters (Category:Pikachu, Category:Togepi (seen on Pikachu on the empennage), Category:Bulbasaur,Category:Squirtle (seen over the trailing edge of the wing), Category:Psyduck (seen right the the exit over the wing), Category:Jigglypuff (seen below the cockpit)
- Pokémon are referenced in the filename and the description.
All of these bullet points (3 of 6) make for that "the file containing copyrighted work X is less likely to satisfy de minimis" per our guideline.
Furthermore, the keeping decisions were made in 2011. In COM:DM Japan, there's a reference to a copyright law amended in 2012. Here's the pertinent part as written on the reference page: "Article 30-2: When creating a copyrighted work of photography, sound recording or video recording, other copyrighted items that are incidental subjects of the work because they are hard to be separated from the item that is a subject of the work may be copied or translated along the work being created (only if they are minor components of the work being created). However, if, considering the kinds of the incidentally included works and the manner of the copying or translation, it unfairly is prejudicial to the interest of the copyright holders of the incidentally included works, they may not."
These Pokémon images cannot fulfil this "incidental" clause, as they are objectively prejudicing the opportunity of Game Freak / Nintendo to license Pokémon illustrations to potential customers wanting to illustrate the characters. Grand-Duc (talk) 11:02, 16 June 2025 (UTC)

Comment A few issues I see. 1) Photo stated to have been taken in 1999; any amendments to copyright law in 2012 would not apply unless they were specifically made retroactive. 2)I am unsure of what group discussion Yann thinks this should be listed at; if there is such a listing open, please link. 3)I have to agree that this looks to be significant COM:DW - the file is currently in use to illustrate certain individual Pokemon characters (!) which would argue against the inclusion being de minimus. So ruling should reflect Japan copyright law DW as of time photo was taken. 4) Would the image still be of in-scope usefulness if the visible character images were blurred or otherwise digitally removed? -- Infrogmation of New Orleans (talk) 14:37, 3 July 2025 (UTC)

Delete per nomination. Jim, I think you did a good job with nominating images that have clearly copyrighted material, and excluding the handful where it's actually de minimis. A lot of the other images in Category:Pokémon Jet should also be deleted; the previous deletion nom was, as noted, improperly closed. Keep and can we stop claiming Commons:Deletion requests/Pokemon Jet was improperly closed - it was not, Jdforrester is an administrator and has been working diligently on Commons for a very long time, demonstrating significant knowledge of copyright legislation and our policies.
The artwork argument is nonsense, frankly. Every aircraft that is not in bare metal/composite, clear lacquer or a single solid colour has some form of artwork on the fuselage of what is otherwise a utilitarian object.
British Airways commissioned Landor Associates to design a new livery which was rolled out from 1984 (much missed, I should add) which was then replaced by the Ethnic tails. There was significant originality in both those liveries, particularly in the Ethnic tails.
Air New Zealand has a complex fern design forming their livery, and other than British Airways and a handful of legacy carriers, most airlines have complex artwork for their livery.
Artwork, whether it's Tintin, Pokemon or the airline's own livery is there for one thing and one thing only, it's advertising. Aircraft don't need logos and colour schemes, a plain white paint job is all they need to protect the fuselage.
We're in danger of differentiating between aircraft/airline livery artwork and comic or other promotional artwork and I see no applicable differentiation that can support this in law.
The images themselves are being generated for one reason - to record a utilitarian object in the process of trying to record each aircraft registration or MSN number. Nick (talk) 16:05, 17 January 2017 (UTC)
I'm open to seeking advice from WMF about this, as I do recognise there's a difficult on squaring de minimis inclusion of copyright artwork which covers such a significant portion of a utilitarian object.
- There's a very significant difference between basic airline livery (some examples: 1 2 3 4 5) and these jets. Standard livery is generally simple geometric patterns, large color swaths, and small logos (many of which are PD-shape anyway). The Pokemon jets are full-aircraft artwork, unambiguously copyrighted. There is a file available of this aircraft in a non-copyrightable livery; that is a utilitarian photograph that has no copyright issues. With that present on Commons, there is no need for images where a copyrighted artwork takes up a large portion of the frame. Pi.1415926535 (talk) 17:12, 17 January 2017 (UTC)

- Four of those are fairly simple geometric patterns, limited to a small portion of the airliner, or both. No question that they're acceptable. The G-EUPA photo is more questionable, but even then it doesn't cover the whole aircraft. In my opinion, File:ANA B747-400D(JA8956) (5699289759).jpg (not included) sets a good borderline between "keepable" and "to be deleted".

- About File:9V-OJJ Pokémon Jet.jpg: per its description, the country of origin is Australia, the still having been taken in Melbourne. So, per COM:FOP Australia, "In order to ensure compliance, two-dimensional artistic works in Australia should not be uploaded to Commons."
- About File:波音787-9 寶可夢飛機.jpg: The file description says something about Hong Kong. But it's not admissible per COM:FOP Hong Kong which refers to COM:FOP UK.
-> These FOP rules reference "works of artistic craftmanship", but I do not see that the descriptions given can be complied with by airplane liveries.

I would argue that they meet the qualification of "they are freely accessible for anyone". - About the notion that the observation deck of FRA is a public space: There is even a disagreement whether subway and railway stations are "public spaces" as mandated in the German FOP law, locations like graveyards should be, even if they get closed at night. The Besucherterrasse, the observation deck at Frankfurt airport, is outside of the security zones and has limited opening hours (at first, I thought that there were security checks, which would have made FOP much less likely applicable, IMHO, but I was mistaken). I think that all circumstances combined still make the observation deck more like the interior of a museum or a stadium, places where German FOP is not applicable, and not like railway stations, where I tend towards applicability. It was actually deemed in a German court (Oberlandesgericht in Cologne IIRC, that's the appellate court of the second level) that shooting from a private balcony, even with legal access to it, is not covered by FOP. As a side notion, the airport actually advertises it as such: "Wir laden Sie herzlich ein, den „schönsten Balkon Frankfurts“ zu genießen – der Zutritt zur Besucherterrasse ist gratis. The files by N509FZ (B-18101@PEK) and File:B-18101 NRT 2025-05-28.jpg do not fall under any of the three criterias listed by the nominator: These are not categorised in relation to several Pokémon characters (unless you count the aircraft category, which is quite a stretch since all aircraft photos are categorised with the plane registration), Pokémon are not referenced in the filename and the description, and they are not used to actually illustrate articles about a Pokémon character. This DR also goes against previous consensus that they do fall under COM:DM or the incidental criteria, because the whole plane is illustrated and not just in part. - OK, that was me sloppily recycling a DR text I wrote for other concurrent cases. But even without a current categorisation as such, the images do not differ much from others which are actually categorised with Pokémon, that one for instance refers "Pikachu" among others, which is more or less as prominent as it is in File:B-18101 NRT 2025-05-28.jpg. So, my arguments should still prevail. Furthermore, the possibly main point of contention in that COM:De minimis is failed by such imagery is indeed also discussed in Commons:Village pump/Copyright#Pokemon Jets deletion requests.
- Jim said in the VPC thread that the basic test whether protected artwork is minimal is if a casual onlooker will notice or fail to notice its presence or absence. So, at least in my eyes, File:4X-AHC Martin Harrison.jpg may be a borderline case with DM applicable - I indeed failed to notice until it got pointed out that it's an actual fish that is painted on the plane, I thought that it was only some fancily arranged colour areas. But the Pokémon are very clearly visible, no casual onlooker would overlook them, in fact, they were presumably the main reason to take the photo. That's not De minimis. Maybe he's also able to provide insights on Chinese copyright laws and judicature, especially if the concept of De minimis does actually exist (or any other Wikimedian he knows and who's able to read and understand the relevant languages). - I’m not too familiar with copyright laws in China, but from the brief research I did, I think the concept of “de minimis” is not that well-defined (compare to other countries), as in there aren’t a proper definition on what count or doesn’t count as “de minimis”.
- In my opinion, I think it would similarly follow the “spirt of the law” for non-FOP of 2D works in China. In COM:FOP China, a court ruling mentioned: “
If a 2D art work is displayed in a public place, others can freely use it for commercial purposes after photographing…the licensing and copyright owner's income will be seriously threatened, then the normal use of the work will be affected and the legitimate rights and interests enjoyed by the copyright owner will be prejudiced.
". So, in my opinion, if the depiction of a 2D artwork in an image will “seriously threatened the copyright owner’s income”, then I don’t think that depiction can be “de minimis” in that image. - For the images nominated above, I cannot truly determine whether the income of “The Pokemon Company” (copyright holder of Pokemon characters and designer of the plane’s livery) will be “seriously threatened” if these image were used commercially. Currently, I do lean more towards the delete side solely based on COM:PCP (for the images taken in China), but I would defer to someone more knowledgeable on copyright law in China to decide whether this is the case.

- I (and not only I) came to the conclusion that this logo is AI-generated, due to several strange artifacts inherent only to AI (look at the whiskers of this squirrel, the lack of paws, etc.). This logo was first appeared in a Telegram post by Alvise Perez, along with another obviously AI-drawn logo with a squirrel (https://t.me/Alviseperez/9842). There (on that not yet vectorized squirrel) other artifacts inherent to AI are visible (for example, several brown pixels on the white part of the tail). Of course, this logo is not officially declared as openly made by AI, but it would be a denial of reality to say that it was made by a human. - @Richard Arthur Norton (1958- ): You are welcome to add rationales or group all the relevant DR. I could not find anything relevant in the appropriate catalogs to prove it either way though, hence they are brought to DR on the basis that they can't be shown not to be out of copyright as other Standard Reference Data publications ARE in copyright ( and can be shown to be so - certain NSRD series titles, certainly are), which these were listed alongside (but not in the same series.). If other contributors think these are PD-US-Gov or PD no-notice, then I am more than happy with that as developed viewpoint, provided a suitable explanation is added to the file descriptions, explaining the specific situation with NBS/NIST originated works, and the other typical boiler plate, about using the actual original for anything serious etc. (although the typical Wikimedia general disclaimer covers a lot of it.)

- Weak Keep, as PublicDomainFan08 mentions, while basically every material posted by the FBI is public domain, but content that focuses on unfree content (be cropped images) could be a copyright violation. Personally I'd say the posters themselves would be still kept by the criteria of de-minimis if they contain Copyrighted content. Unfortunately Federal Agencies (FBI, CIA, US Marshals) rarely mention if the photos that were provided by them were waived by the rights owners or are just used to illustrate on the suspects on particular. (The only instances where a cropped photo could be used if its a record of a state that publishes it as Public Domain, for example: Florida, or CCTV footage as it is non human content.) You cannot simply claim that it was published before 1963 without any actual evidence, and you cannot verify that said theoretical pre-1963 publication did not have its copyright renewed without any details about the publication. - Pi.1415926535 changed it back to what they are saying is wrong, and I corrected it again. For a USA copyright you must register for a copyright and renew that copyright and comply with other copyright formalities such as having a prominent copyright symbol and the year and the copyright holder. No image using the word "Allamuchy" appears in the copyright registration database or the copyright renewal database. We generally reserve "unpublished" where we have a clear provenance that shows the image remained as a negative in an archive since creation, otherwise USA case law declares an image has been "made public" when a print leaves the custody of the creator. - There is zero evidence of when the photo was published, or whether that publication was copyrighted. You cannot simply take the best-case scenario and arbitrarily declare that to be the truth. This may have first appeared in printed material before 1963 that was copyrighted and renewed as a whole publication, or between 1963 and 1989 but with a proper copyright notice, or after 1989 - and in any of those scenarios it would be copyrighted.
